MakerCommand Terms of Service
Effective date: 28 February 2026
These Terms of Service ("Terms") govern access to and use of the MakerCommand platform and related services (the "Services").
By registering for or using the Services, you agree to these Terms.
Section 1
Nature of the Services
MakerCommand provides a cloud-based software platform that enables independent 3D printing businesses ("Farms") to manage quotations, customer orders, payment integrations, production workflows, and shipping label generation.
MakerCommand provides software tools only.
MakerCommand:
- Is not a manufacturer.
- Is not a distributor or reseller.
- Is not a marketplace operator.
- Is not a broker or agent of any Farm.
- Is not a party to contracts between Farms and their customers.
- Does not take title to goods.
- Does not control pricing, manufacturing methods, materials, or fulfilment decisions.
All contracts for goods or services are solely between the Farm and its customer.
Section 2
Eligibility and Business Use
The Services are available only to individuals or entities acting in the course of a business or trade.
By registering, you represent and warrant that:
- You are operating as a business.
- You have authority to bind your business.
- You will comply with all applicable laws and regulations.
MakerCommand does not provide Services to consumers acting in a personal capacity.
Section 3
Farm Responsibilities
Each Farm is solely responsible for:
- Product design, manufacturing, and quality control.
- Compliance with product safety regulations.
- Consumer protection compliance.
- Taxes, VAT, duties, and customs.
- Setting and communicating pricing.
- Handling refunds, returns, and disputes.
- Shipping and delivery performance.
- Ensuring lawful use of uploaded files.
MakerCommand does not inspect, approve, or guarantee goods produced by Farms.
Section 4
Third-Party Services
The Services integrate with third-party providers, including payment processors and shipping carriers.
MakerCommand:
- Does not control third-party services.
- Is not responsible for third-party outages.
- Is not responsible for payment failures, chargebacks, or account suspensions.
- Is not responsible for shipping delays, losses, or carrier performance.
Your use of third-party services is subject to their terms.
Section 5
Platform Availability
The Services are provided on an "as is" and "as available" basis.
To the maximum extent permitted by law, MakerCommand disclaims all warranties, express or implied, including:
- Fitness for a particular purpose.
- Merchantability.
- Non-infringement.
- Continuous or uninterrupted availability.
- Accuracy of automated calculations or slicing outputs.
Farms are responsible for reviewing all pricing and production settings before fulfilling orders.
Section 6
Intellectual Property
MakerCommand retains all rights in the platform, software, APIs, documentation, and branding.
Farms retain ownership of uploaded content but grant MakerCommand a non-exclusive, worldwide, royalty-free licence to host, process, transmit, and store such content for the purpose of operating the Services.
Farms represent that they have the necessary rights to all uploaded content.
Section 7
Acceptable Use
Farms must not:
- Upload unlawful or infringing content.
- Use the Services to produce illegal goods.
- Attempt to reverse engineer the platform.
- Interfere with system integrity.
- Circumvent platform safeguards.
MakerCommand may suspend or terminate accounts at its sole discretion where necessary to protect system integrity, comply with law, or prevent harm.
Section 8
Limitation of Liability
To the maximum extent permitted by law:
MakerCommand shall not be liable for:
- Loss of profits.
- Loss of revenue.
- Loss of business.
- Loss of goodwill.
- Loss of data.
- Indirect, incidental, special, or consequential damages.
MakerCommand's total aggregate liability arising out of or relating to the Services shall not exceed the total fees paid by the Farm to MakerCommand in the 12 months preceding the event giving rise to the claim.
Nothing in these Terms excludes liability that cannot legally be excluded, including liability for death or personal injury caused by negligence or fraud.
Section 9
Indemnification
You agree to indemnify and hold harmless MakerCommand from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:
- Products manufactured or sold by you.
- Customer disputes.
- Breach of applicable laws.
- Intellectual property infringement.
- Misuse of the Services.
- Regulatory investigations relating to your business.
Section 10
Suspension and Termination
MakerCommand may suspend or terminate access immediately where:
- You breach these Terms.
- Payment is overdue.
- Required by law.
- Necessary to prevent risk, harm, or legal exposure.
MakerCommand is not liable for losses arising from lawful suspension.
Section 11
Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
